Indiana Republicans passed a law earlier this year saying public colleges and universities must deny tenure to professors who are “unlikely to foster intellectual diversity.” Professors who already have tenure will be judged every five years, and can lose their tenure or their jobs. It's a stupid law that violate the First Amendment. But Indiana's attorney general said in court that “the classroom curriculum of a public university is government speech set in accordance with State law,” and “professors have no right to control how the State speaks.” The Supreme Court ruled on this issue almost 60 years ago, affirming that academic freedom is “a special concern of the First Amendment, which does not tolerate laws that cast a pall of orthodoxy over the classroom.”

But with today's Calvinball Court, who can confidently say Indiana's lawless law will not prevail?

New College of Florida tosses hundreds of library books, empties gender diversity library

A dumpster in the parking lot of Jane Bancroft Cook Library on the campus of New College overflowed with books and collections from the now-defunct Gender and Diversity Center on Tuesday afternoon. Video captured in the afternoon showed a vehicle driving away with the books before students were notified. In the past, students were given an opportunity to purchase books that were leaving the college's library collection.

The college sent a statement to the Herald-Tribune, denying it had done anything legally or educationally wrong. But as the Tampa Bay Times reported, “Statements from New College have been contradictory, at times even incongruous with the law.” And lo and behold, when the story gained traction, library dean Shannon Hausinger was put on administrative leave, and is unavailable for comment. When the Herald-Tribune reporter asked the school's spokesman three times why the school’s statement contradicts the law, there was no reply.

Last year, Gov. DeSantis appointed six new members to the college's board of trustees. The board then fired the president and installed the former Florida House Speaker in his place. Board member Christopher Rufo tweeted photos of the discarded books while crowing "We abolished the gender studies program. Now we’re throwing out the trash."
