McCullen v Coakley (2014), decided unanimously.
Antonin Scalia, writing:
“Protecting people from speech they do not want to hear is not a function that the First Amendment allows the government to undertake in the public streets and sidewalks.”
The ruling affirmed the rights of abortion protesters to do so in public spaces without excessive state or police restrictions.
Funny how those protesters' aggressive and abusive tactics did not "boomerang," but this is sure to be self-defeating brinksmanship.
The Court was silent on the certainty of Brett Kavanaugh and his family never again eating another meal prepared outside their home without the worry that it will contain human waste.
