Scenes from a Boston pizzeria 
 

This is such a great story from today’s Globe: “Sign of Bush’s support surfaces” 

Even though he voted for George W. Bush four years ago, Mark F. Pasquale was looking forward to the Democrats coming to town, especially since the pizza shop he has run for the past 23 years is right across the street from the FleetCenter. But then the barriers started going up, the security rules kept getting changed, and he finally had enough. He's closing during the convention and leaving behind a banner in support of Bush.
 
''It seems like there was supposed to be a party, but it turned out to be a private party," said the 51-year-old Pasquale, who was deluged with media attention yesterday as the 24-foot-long, 4-foot-high banner draped across the building started getting noticed. ''They have 30,000 prepared meals . . . I put my food against anybody, but you can't compete against a free meal."

I believe that I heard reported today on WRKO in Boston that the city had ordered the sign removed, and the owner is going to leave it up and pay a fine.

Sorry to say this but businesses don't necessarily have the same freedom of speech rights. Especially concerning the exterior of their business locations. If the city of Boston has specific regulations that cover business signs, which this might be considered as, then he'd have to follow those regulations.

A prime example in NYC were the ridiculous regulations covering *awnings* for businesses. According to the NYC regulations these *awnings* couldn't have anything other than the businesses name. No phone number, fax number, web address or anything. There was a significant amount of aggravation in the business community over this and the attendent fines.

Halftime Pizza is a bit of an institution in Boston, especially among the Bruins and Celtics fans. It's been there for as long as I can remember (about 20 years now), and I have fond memories of my dad taking me for pizza before a Bruins game. Halftime would run videos of Don Cherry's Rock-em-Sock-em Hockey on the CCTV in the restaurant. The pizza is great, too, especially if you get it fresh from the oven.

Where to send money for the fine? How about making a trip to Boston, and stopping in for a slice or two!

This is not the same as an advertisment awning. This is pure political speech, and is it the most protected form of speech. If he is a sole proprietor (rather than operating under some sort of corporation) he has EVERY right that any other citizen has. I think Boston is going to take a black eye if they persue the fine.

Sorry, I don't care if it is free speech. If the cities have reulations regarding banners, then he has to follow them. Just as putting a flier or sign on a lightpole in many cities is illegal, in some cities, it's also illegal to have a sign that's not permanently affixed to the building.

It's not about free speech or the content, it's about the local code regarding signs of this nature.

I spoke with a guy inside the pizza place...

Business has INCREASED since the banner made headlines.

New this morning, City inspectors are threatening the pizza shop owner with fines until he takes down the banner... the owner refuses to, and will accept all fines.

As far as the fine - it appears that the owner was singled out for the fine - there are plenty of other businesses in the area and in Boston that have these types of signs up without a permit. This is just the city bureaucrats trying to stiffle him

I'd like to know what ordinance the city plans to fine him. I found this, which may or may not be applicable, but seems to strengthen the free speech case and weaken the zoning argument:

The following signs, displays and devices shall be exempted from the regulations contained in this division:

(j) Political campaign or election signs located outside of public rights-of-way, provided such signs are not erected for more than sixty (60) days, are removed within fourteen (14) days after the campaign or election to which they pertain;

Is this guy protesting the extra security or the free food the party is giving to those attending? I am 100% in favor of free speech, and I think this guy had a great idea to let his feelings be known, but if he is complaining about the loss of traffic to his business because of barricades and the hordes of extra security forces, he should re-think of the consequences.

I just breezed through the above comments, so I don't know if this has been addressed as of yet. I support the Pizza guy. I applaud his banner. Sure there may be Zoning Regulations that give the city legal grounds to say "take it down your breaking the law". But um was the boston tea party legal?

We all have an obligation to be Gov watchdogs. If its done in an expresive nonviolent way. He may have broken a law, but hes got the attention that may open some eyes.

I'm not decided yet, I may vote bush in a few months I may not. But regardless I still believe "For The People By The People"

A local ordinance does not mean it is Constitutional. My university does not allow us to hang American flags out the window because it could be a 'hazard' after 9-11. They threatened to fine those who did and well people did and paid the fine.

As for Mr. Pasquale, well the fine is wrong and I hope he comes along posting a paypal account to help with the fine, but either way I think I found my new favorite resturant in Boston.

It seems to me that this guy is putting up a sign in favor of the guy who established the term "free speech zone" in the first place. Ceteris Paribus, I think the sign should be allowed, though I think it is inherently counterproductive to the cause he espouses.

I am a conservative right winger myself, but the comment left about the truth being in your face has me scratching my head too. However, be advised the Dems also have their lunatic fringe, (who will undoubtedly be the ones to rip the sign down in the wee hours).

The reason they want the sign down is because it would be an affrontery to what's going on across the street. Any code regarding signage, while valid to a point, is merely window dressing in this issue. If it said "GO USA" and nothing else was on it, we wouldn't be posting. Proof had better not show the city as being inconsistent in sign / banner enforcement.

The tight security is not because of Bush, it is a step necessary because of 9/11. Also bush was only in office 8 months prior to 9/11 and Clinton had 8 years prior to address security issues. Changes do not happen over night. If security was addressed in Clintons eight years in office (especialy after the 93' trade center bombings) things may be different now.

PS this is a national convention in the "Age of Terror". To be surprised and horrified by the shifting security rules and preparations when you are across the street from the venue is what Bill Maher calls "FALSE OUTRAGE". I'll give the benefit of the doubt and say he's trying to make a smart buck though.

I hate George Bush with all my might, but I'd gladly and willingly donate to this man's "pay my fine" fund. Nobody, and I mean nobody, should ever have their right to free speech suppressed, whether or not you support what they have to say. This man is perfectly entitled to put up whatever banner he wants.

The same kind of convention madness is going on in NYC right now, with tight-lipped city officials not giving out any information about the Republican convention and driving people who live and work in the area into a frenzy of impatience and aggravation. As as far as I'm concerned, both the Republican and Democratic parties should be ashamed of themselves for allowing the citizens of their convention host cities to be pushed around like this. It's disgusting.

If being a guest in my city means that you get to push me around, or that city officials get to push me around because you're going to be staying here a while, then take your business, and your convention, elsewhere.

Both parties should have long ago spoken up and demanded that citizens be treated more fairly and that information regarding security and other area restrictions be made public long before the conventions hit town. Bah.

You guys speak as if this has NEVER happened to liberals that post anti-Bush signs. I remember a guy putting up a sign on HIS house on HIS property that HE owned and the town was fining him for having his sign out. The problem is...this guy is probably leasing the property (meaning, owned by someone else) and might be violating local ordinance.

Also, I can't tell you how often Bush screws people over when he visits. Every time he visits Atlanta the interstates entering and leaving the city have been shut down. I had to call my work one day and say I couldn't make it in because the street I lived on was blockaded and I couldn't leave the parking lot! So stop playing the "poor ole conservative" line.

Whether I agree or disagree with this guys politics or even his motivation is not really relevant. Here we clearly see the City of Boston engaged in violation of 2 very dear rights gauranteed under the U.S. Constitution - first, as everyone has noticed, is the right to free speech which has seen more time being proven out in courts of law than almost anything else - this is the real no-brainer that Boston has failed to notice. The second is equal protection under the law - if it is wrong for him to post his banner, it is equally wrong for every other business to post banners without permits and this includes the DNC. However, it seems Boston picks and chooses which businesses to prosecute (or is that persecute). Unfortunately, I am not liscenced in the state of Mass. but I know a few good men (and women) who would be more than thrilled to have the chance to re-enact a courtroom version of that famous tea party pro bono -- I would love to be in that fight but am glad to help as I can including providing references for pro bono attorneys and helping defray any costs or fines - as Thomas Jefferson said - the tree of freedom must occasionally be watered with the blood of patriots

The government, under law, does not have the right to deny freedom of speech, but can regulate, time and place. It is not uncommon for speakers to be segregated by content... while this case is not nearly as pointed as days when the KKK and Black Panthers protest, the law does allow for regulation of time and place. This is pretty much how the government is able to seperate parties in a variety of events.

It sucks the guy had to close his business for the convention, but I wouldn't say this is directly the fault of the DNC as it is heightened security measures at the federal level as well as the security the Police Commissioner of Boston is surely in the process of working out. I'm sure the DNC will be much less of a fiasco than the RNC in New York City. At least Boston is a Democratic town, voting and contribution wise. The republicans are not wanted in New York City and there are a number of organizations that oppose it. It is insulting that they choose NY this year, the first year they have ever come here, because of our terrorist attacks and the guise that we support what has been happening to our country. It should be really interesting...

Great for the owner, do what you want, but we have terrorists threatening the convention. Imagine that we have heightened security at the convention that is being threatened by terrorists. Excuse the DNC or the secret service from trying to be extra cautious. I hope by the end of the convention the pizza place is still standing. Maybe he closed the shop to be away from a potential target.

Of course, the Democrats who supported Bin Laden in Bosnia (notice that Osama's buddy-chauffeur who gave up last week was injured in....Bosnia. Of course you didnt...the media will totally bypass this) and Kosovo (The largest terrorist army in'99 ? Albanian KLA according to the CIA. Made Al Quaeda look like random sheep herders) gwill et away scot free even though they are fully responsible for supporting muslim terrorists. They aided arms smuggling from Iran to Bosnia and thousands of Beaner's muhajedins and we suffer collective amnesia. Read a little past the litter liners and you'll see that Kosovo was a test-run for the BS we were fed in Iraq.
Democrats gave Beaner carte blanche and have created TWO muslim states in Europe.

In any case, as stated earlier, the same type of security pains and headaches are happening in NYC with the Republican National Convention. Yeesh. Let's just face the facts that America is acting a little bit differently since 9/11--both Republican America and Democratic America.

The guy has every right to his opinion as others here have said. I'm one of those nasty "liberals" the right wing is always writing about, but I don't think one would expect anything different when the man states he voted for Bush in 2000. It's his right to declare his opinion.

On the other hand, my Boston friends, what do you think would happen if he put up a similar sign stating "The Bruins Suck"? Would it last the night?

In the end, we defend his right to free speach, and decry anyone who would attempt to take it away. We ignore the fact that if he were criticizing the local sports team, post 9/11 security would not hold back the rath of hell from public and personal reprisal. My conclusion is, let's lighten up and enjoy this immensely positive political season. The pols will be wallowing in the dirt soon enough for all of us.

Wow. Some uh, interesting posts here. I'll address a few points.

Look, cities have zoning regulations that take precedent NO MATTER the content of the sign. Many even have regulations about such things as posting a "for sale" sign on a car that isn't parked in a lot zoned for car sales. It happens. As one user mentioned, it isn't about the content of the speech--it's about the time and place.

Kerry has nothing to do with the planning of the convention. I'll bet the DNC doesn't either--they probably hired a company to take care of everything.

This guy wasn't forced to do anything. And look around--no other businesses are leaving because of it. The whole city is affected in some way, if for no other reason than because the traffic is detoured. Everyone inside that zone is affected.

The laws have been around, unchanged. It isn't "Boston pencil pushers (?)"--these are standard regulations in every city. Heck, they might even say the sign is too big. Regardless, they didn't just create a rule because they don't like the guy or his message.

Also, some of you people are really nuts.

What I think are the most germane arguments in favor of Mr. Pasquale's right to retain his sign are these:

1) According to persons *in* Boston, other businesses have banners of various types on the facades of their businesses, or on the property where their businesses are located. Mr. Pasquale (or some supporter who wishes to help) should get photos and/or video of some of these banners, including the alleged DNC banner on the hotel. If those businesses are not being prosecuted and fined as the City of Boston is threatening to do to him, he has a good case for dismissal under equal protection.

2) Mr. Pasquale can also make some First Amendment arguments, though it appears the city ordinance regarding signage may restrict those rights. The question would then be whether or not the city's rights to govern its citizens outweigh the citizen's rights under the Constitution.

Regardless, the City's inspectors, or whoever initiated the action against Mr. Pasquale, apparently have no idea that this is a new world, with worldwide transmission of information in a matter of moments. The PR nightmare that they will soon learn they have on their hands will far outweigh their desire to pander to the DNC - or any organization that they're afraid to have insulted.

Hey, whether or not you agree with this guy, his First Amendment rights should be protected. I actually AM a Republican, but I wouldn't have a problem if this guy had a pro-Kerry sign, either - he has a right to his opinion, and it's his property, let him post whatever he likes. He's not hurting anyone. Let's lighten up. If we don't have freedom of speech, what's the difference between us and, say, Iraq?

Why is the Fleet Center DNC sign STILL UP? I drive by it on I-93 everday and wonder if the pizza shop still has its sign up... The RNC is on this week and the DNC sign hasn't come down yet. I don't get it...

Update. It is Sept. 30, 2004 and the DNC Sign is STILL on the Fleet Center... Will they take it down after Bush is re-elected? Only time will tell!

Update: As of 11-11-2004, Bush has won the election, and the DNC sign on the Fleet Center is still up! Maybe Bank of America will take it down when they take completely change over all of the Fleets in Boston... I'll let you know!
